George Floyd’s family announced Tuesday that they will file a $250 million lawsuit against the rapper, formerly known as Kanye West. Drink Champs.

The Hennepin County Medical Examiner’s Office has ruled George Floyd’s death a homicide, caused by Derek Chavin kneeling on Floyd’s neck for more than eight minutes. But Yeh – who was a guest on last weekend’s episode of a podcast hosted by rapper NORE and DJ EFN – pushed the idea that Floyd’s death was not caused by Chavin, but by his use of fentanyl.

The family is seeking damages for defamation, harassment and more

The suit will be filed by Roxie Washington, the mother of Gianna Floyd, the only daughter of George Floyd and the sole beneficiary of his estate. Washington plans to sue Yeh and his business partners and associates for “$250 million in damages for harassment, abuse, defamation and emotional distress.” According to a report From Washington’s Lawyers.

“Kaney’s comments are a despicable attempt to discount George Floyd’s life and profit from his inhumane death,” said attorney Pat D. Dixon III said. “We hold Mr. West accountable for his blatant comments against Mr. Floyd’s legacy.”

The family’s lawyers have also issued Ye with a cease-and-desist letter for his comments.

“Free speech rights include harassment, lies, misrepresentation and misappropriation of George Floyd’s legacy. Some words have consequences, and Mr. West needs to understand that,” said Kay Harper Williams, another Washington attorney.

Yeh’s First Amendment rights will be a factor in the case, the expert says

However, when it comes to First Amendment rights, the family may face an uphill legal battle against Yew, said Roy S. Guterman said.

“First of all, there’s no possibility of a defamation action here, because there would be no living plaintiff for reputational damage,” Katterman told NPR. “Defamation and defamation require a direct plaintiff, and family members or surviving family members cannot sue for defamation.”

One possible path forward for this case would be a charge of intentional infliction of emotional distress, Guterman said — though that would be difficult to claim. “The plaintiff must prove that these statements were intentional or reckless, went beyond the bounds of accepted morality and decency, and were associated with some potential harm,” he said. “This tort is often a difficult claim, especially with a media defendant.”

However, this claim is not impossible to prove; Specifically, the Sandy Hook families sued Alex Jones for this second-degree tort in a recent civil trial in Connecticut.
