George Floyd’s Family to File $250 Million Lawsuit Against Ye, Kanye West: NPR

George Floyd’s family announced Tuesday that they will file a $250 million lawsuit against the rapper, formerly known as Kanye West. Drink Champs.

Yeh’s First Amendment rights will be a factor in the case, the expert says

However, when it comes to First Amendment rights, the family may face an uphill legal battle against Yew, said Roy S. Guterman said.

“First of all, there’s no possibility of a defamation action here, because there would be no living plaintiff for reputational damage,” Katterman told NPR. “Defamation and defamation require a direct plaintiff, and family members or surviving family members cannot sue for defamation.”

One possible path forward for this case would be a charge of intentional infliction of emotional distress, Guterman said — though that would be difficult to claim. “The plaintiff must prove that these statements were intentional or reckless, went beyond the bounds of accepted morality and decency, and were associated with some potential harm,” he said. “This tort is often a difficult claim, especially with a media defendant.”
